Please also note that under California law, businesses are only required to respond to a customer request once during any calendar year. The California Online Privacy Protection Act requires that we outline our practice as it is related to federal do-not-track signals that may come from your browser. Because this signal does not often reflect the preference of our consumers, this website does not respond to it. Users may, however, request to opt out, as discussed earlier in this Agreement. For International Users. This Site operates in the United States and as a result, the information we collect may be stored in the United States. By using the Site, you acknowledge and agree that your information may be transferred to, used, processed, or held by Nuka Enterprises in the United States and in other countries, including countries outside of your country of residence and used for the purposes set out in this Policy. Privacy Shield - EU – US and Swiss US Data Transfers: While our products are only available to consumers in the United State, the Site is accessible to international users. If you are located outside the United States and provide personal data to us, we may transfer your personal data to the United States and process it in the United States in accordance with this Privacy Policy. Our Obligations to you under the Privacy Shield We comply with the E.U. – U.S. and Swiss – U.S. Privacy Shield Framework (“Privacy Shield”) as set forth by the U.S. Department of Commerce and approved by the European Commission and Swiss Federal Council regarding the collection, use, and retention of personal information we receives from European Union member countries and Switzerland. If there is any conflict between the terms in this Policy and the Privacy Shield Principles, the Privacy Shield Principles shall govern. We are required to take certain steps when transferring personal information received from the European Union and Switzerland to third parties (such as including necessary contractual provisions in any third party contracts). Privacy Complaints Handling, Recourse and Enforcement: In compliance with the Privacy Shield Principles, Nuka Enterprises commits to resolve complaints about your privacy and our collection or use of your personal information (without charge to you).
